Florida Cannabis Legalization Update

The recreational cannabis initiative did not qualify for the November 2026 ballot β€” but the fight continues. Here's where things stand.

Initiative Did Not Make the 2026 Ballot

Smart & Safe Florida fell short of the required 880,062 valid signatures by the February 1 deadline. A court ruling invalidated roughly 70,000 signatures collected by non-resident petitioners.

What happened

  • In 2024, Amendment 3 received 56% of the vote β€” just short of the 60% needed
  • Smart & Safe Florida relaunched for 2026 with revised language including home cultivation provisions
  • The state invalidated ~42,000 signatures from inactive voters and ~29,000 from non-resident petitioners
  • The 1st District Court of Appeal upheld the invalidations in January 2026

What's next

  • Medical cannabis remains legal in Florida for qualifying patients
  • Marijuana rescheduling to a less restrictive federal classification remains under way
  • Legalization advocates are expected to target the 2028 election cycle
  • Support among Florida voters remains strong β€” a 2025 UNF survey showed 66% support for legalization

Stay registered: even though cannabis isn't on the 2026 ballot, your vote still matters for local Cape Coral and Lee County races. Cape Coral voters β€” contact the Lee County Supervisor of Elections for your polling location.

Cape Coral is the largest city between Tampa and Miami by land area. With rapid population growth, demand for dispensaries has surged.

Two Main Corridors

Most dispensaries cluster along Del Prado Boulevard (east) and Santa Barbara Boulevard (west). Choose your corridor based on which side of the Cape you're on.

Florida Cannabis Law in 2026

What's legal, what's not, and what's changing. Stay informed about Florida marijuana laws and stay safe.

What's Legal

Medical cannabis is legal for qualified patients 18+ with a valid Florida medical marijuana card. Approved qualifying conditions include chronic pain, PTSD, cancer, epilepsy, glaucoma, Crohn's, Parkinson's, MS, and others. Smokable flower, edibles, vapes, tinctures, topicals, and concentrates are all permitted.

What's Not Legal

Recreational cannabis remains illegal in Florida as of 2026. Possession of 20g or less without a medical card is a misdemeanor (up to 1 year, $1,000 fine). Over 20g is a felony. No public consumption. No home cultivation.

Edibles & Products

Medical patients can purchase edibles, capsules, tinctures, and infused products from licensed dispensaries. Products are lab-tested with THC/CBD labeling. Supply limits run on a 70-day cycle for non-smokable products, capped at 24,500 mg of THC in total; smokable flower is a separate 35-day supply capped at 2.5 ounces. Your physician certification is what runs about 210 days β€” that is the recertification clock, not a purchase limit.

Delivery in Cape Coral

Several Cape Coral dispensaries deliver across all four quadrants of the Cape β€” NW, NE, SW, SE. Orders are verified at your door with your medical card and state ID. Some offer free delivery over $100.

How to Get Your Florida Medical Marijuana Card

Cape Coral residents β€” the process is faster than you think. Many MMJ doctors offer telehealth appointments from home.

See a Doctor

Visit a state-certified marijuana physician. Many Cape Coral and Fort Myers area doctors offer telehealth. $150–250 typical.

Get in OMMU

Your doctor enters you into the Office of Medical Marijuana Use Registry with your qualifying condition and places your orders. Since July 27, 2026 you need a current or scheduled certification with open orders before the state will accept your card application.

Apply Online

Complete the application at mmuregistry.flhealth.gov. Upload a photo and pay the $75 state fee plus the $2.75 processing fee.

Receive & Shop

Your card arrives by email (temporary) and mail. Shop at any Cape Coral dispensary. Valid one year.

Frequently Asked Questions

The state charges $75 plus a $2.75 processing fee β€” $77.75 β€” for the Medical Marijuana Use Registry ID card. Physician certification visits typically run $150–250 and are separate. The state card is renewed annually; your physician certification runs on its own roughly 210-day cycle, so budget for more than one visit a year.
Trulieve, MÜV, Sunnyside, and Sunburn deliver across Cape Coral. Free delivery on qualifying orders (usually $100+). Card and ID required at the door.
No. Public consumption is illegal β€” beaches, parks, restaurants, vehicles, and all public spaces. Cape Coral patients must consume in a private residence.
Cancer, epilepsy, glaucoma, HIV/AIDS, PTSD, ALS, Crohn's disease, Parkinson's, multiple sclerosis, chronic nonmalignant pain, and other comparable conditions as determined by a physician.
Not currently. Home cultivation is illegal in Florida. SB 1398, introduced in 2026, would allow up to 6 flowering plants for medical patients if passed.
Cape Coral dispensaries cluster along Del Prado Blvd and Santa Barbara Blvd. Fort Myers has additional locations along Cleveland Ave, US-41, and Daniels Pkwy. Most brands operate in both cities, but Cape Coral locations tend to be less crowded with shorter wait times.

Daily Cannabis Tip

Tip for July 28
